1. Acceptance of Terms
By accessing and using the services of Antique Restorations By Peggy ("we," "us," or "our"), you ("customer," "client," or "you") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
Antique Restorations By Peggy provides professional furniture restoration and refinishing services, including but not limited to:
- Antique furniture restoration and repair
- Wood refinishing and surface restoration
- Chair re-caning and upholstery services
- Structural furniture repair
- French polishing and traditional finishes
- Hardware restoration and replacement
- Custom furniture finishing
- Pickup and delivery services
3. Service Agreement Process
Initial Assessment
All restoration projects begin with an assessment of the furniture piece(s). We will provide a detailed quote including scope of work, materials, timeline, and pricing.
Acceptance and Authorization
Work begins only after you accept our written quote and provide authorization. A deposit may be required before work commences.
Changes to Scope
Any changes to the agreed scope of work must be approved in writing and may result in additional charges and timeline adjustments.
4. Pricing and Payment
Pricing
All prices are provided in writing and are valid for 30 days from the quote date. Prices may vary based on the condition of furniture and specific requirements discovered during restoration.
Payment Terms
- Deposit: A deposit of 25-50% may be required before work begins
- Progress payments may be requested for large projects
- Final payment is due upon completion before delivery
- Accepted payment methods: cash, check, credit card, bank transfer
Late Payments
Late payment fees may apply to overdue accounts. Items may be held until full payment is received.
5. Customer Responsibilities
- Provide accurate information about furniture history and condition
- Disclose any known structural issues or previous repairs
- Ensure items are prepared for pickup as agreed
- Make timely payments according to agreed terms
- Inspect completed work promptly upon delivery
- Communicate any concerns or changes promptly
6. Our Responsibilities
- Provide professional, quality restoration services
- Use appropriate materials and techniques for each project
- Communicate regularly about project progress
- Complete work within agreed timelines (subject to unforeseen circumstances)
- Handle furniture with reasonable care during restoration
- Provide documentation of work performed
7. Limitation of Liability
While we take utmost care with all furniture pieces, restoration work involves inherent risks. Our liability is limited to:
- The value of services provided, not to exceed the contract amount
- Direct damages only; we are not liable for indirect or consequential damages
- We are not responsible for pre-existing conditions not disclosed or discoverable during initial assessment
- Antique furniture may have hidden structural issues that become apparent only during restoration
8. Insurance and Risk
We maintain general liability insurance for our operations. However:
- Customers are encouraged to maintain their own insurance on valuable items
- We recommend documented appraisals for high-value pieces
- Insurance claims should be reported immediately
- We will cooperate with insurance investigations as needed
9. Pickup and Delivery
Scheduling
Pickup and delivery appointments must be scheduled in advance. We will provide reasonable notice of any schedule changes.
Access and Assistance
Customers must provide reasonable access to furniture location and may need to assist with moving items to/from vehicles.
Risk During Transport
We take reasonable precautions during transport, but customers should ensure adequate insurance coverage for valuable items.
10. Storage and Abandonment
Completed furniture will be stored for up to 30 days after completion notification. After this period:
- Storage fees may apply
- Items not collected within 90 days may be considered abandoned
- We reserve the right to dispose of abandoned items to recover costs
- Reasonable efforts will be made to contact customers before disposal
11. Intellectual Property
We may photograph restoration work for:
- Documentation and quality control purposes
- Marketing and promotional materials (with customer consent)
- Educational and training purposes
Customers may request that their items not be photographed for promotional use.
12. Cancellation and Refunds
Customer Cancellation
- Projects may be cancelled before work begins with written notice
- Deposits may be refunded less any costs incurred
- Cancellation after work begins may result in charges for work completed
Our Cancellation
We reserve the right to cancel projects if furniture condition makes restoration inadvisable or impossible. Full refunds will be provided in such cases.
13. Dispute Resolution
We encourage direct communication to resolve any concerns. If disputes arise:
- Initial resolution attempts should be made directly with our management
- Mediation may be pursued for unresolved disputes
- Legal disputes will be governed by Mississippi state law
- Jurisdiction for legal proceedings is Jackson County, Mississippi
14. Modifications to Terms
These terms may be updated periodically. Changes will be posted on our website with an updated effective date. Continued use of our services constitutes acceptance of modified terms.
